Good afternoon friends! I hope everybody had a wonderful 4th of July. These last few weeks have been busy to say the least. I wanted to stop in and talk about Agreed Divorces.
An "Agreed Divorce" means that both parties agree on ALL of the terms of the Divorce at the time of filing, whereas a "Contested Divorce" indicates that the parties are filing the action with disputes over the terms of asset division, custody/timesharing, or a whole host of other issues.
Sometimes it may be hard to tell which category your situation falls into — even couples who are on good terms can discover disagreements once they sit down and start working through the details. That's completely normal, and it doesn't mean your case is destined to become a drawn-out legal battle.
The good news? An Agreed Divorce is almost always faster, less expensive, and less stressful than a Contested one. When both spouses can come to the table and reach an understanding on things like property division, debt allocation, and (if applicable) custody and support, we can often finalize the process in a fraction of the time it would otherwise take — without the added emotional toll of prolonged litigation.
And if you already tried to handle things yourself — filling out forms online or attempting a self-help/pro se divorce — and it didn't go quite as smoothly as you'd hoped, don't worry. That happens more often than people think, and it's not too late to get things back on track. I'm happy to step in, review what's been filed, and help you sort out any mistakes or missing pieces so your case can move forward correctly.
If you're considering divorce and aren't sure whether an agreed approach is realistic for your situation, that's exactly what we're here for. A short conversation with our office can help you understand your options and figure out the smoothest path forward.
